I became a permanent resident 3 years ago through my daughter who sponsored me to become a resident. I am currently living and working in the United States for 3 years. My wife is not living with me because she is not a a permanent resident nor citizen but she is Canadian and we have been married for 32 years. If she is Canadian does she have more advantage than others? Also can I sponsor her to become a resident so she can come and live with me?

  1. Yes you can apply for her but her priority will be like an F3 which will probably mean a long wait to get her residency.

  2. At this point it takes about 5 years min. for a permanent resident to sponsor a spouse. She would be on a list of "possible immigration risk" and would most likely not be permitted into the US. You would be able to visit her.

If you wait until you become a citizen (5 years after green card) you could then apply. It would take about 1 year for the citizenship paperwork to go through and then another 6 months for her paperwork. She might be able to stay off the list.

So 5 years if you apply now or wait 3 years and apply then another 6 months = 3.5 years.  And that's if the time tables don't change no the laws. Sorry I couldn't be of more help.

  3. Yes you can sponsor her. However, realize that with immigration issues, it will take time to get her approved for a resident alien card and all. Just go ahead and submit for the papers. It could take as long as a year. I'm still waiting on my husband's papers. I submitted for them in January. They tell me I won't know anything till January next year.

  5. Yes, but your priority level is rather low.  Good luck.

  6. No to advantage and yes to becoming a resident.  But it would be best if you file for your citizenship first because the wait is long when you are  a permanet resident. Form I130. What u can do is get married, file the paper and when your status changes, her automatically changes, to spouse of a citizen! Good luck.
