He is here in the States on a H1 work visa, and we will be marrying while he is still working here. Can someone give me the specifics, or what to do legally?

  1. As you have already been told, once you have married you have to file for Adjustment of Status. One important point is that he should not leave the country after the marriage until he has his green card in his hand. If he is lucky it will take no more than six months. If he has any business in Canada tell him to go deal with it before you are both married and he shouldn't mention his impending marriage to immigration on his way back unless he is specifically asked about it.

http://www.visajourney.com is a useful source of free information and support while you get all your paperwork together.

  2. After you get married, you contemporaneously file an I-130 Petition, and an I-485 Application to Adjust.  The forms are available at www.uscis.gov

Follow the instructions very carefully.  Otherwise, contact a reputable immigration lawyer in your town.  Attorney's fees typically run from $2,000 to $3,000 if you go that route (and there are no other problems, like criminal record or prior immigration problems).  But don't get suckered into paying more, unless you have other "issues" like having to ask for waivers of prior criminal conduct.

    Good luck.
