I am a US Citizen on foodstamps, can I still help my husband get his green card?

He is ilegally here in New York and I want to know is it's possible for me to help him get his green card while I am on the food stamp program. We have 2 kids together. Thank you for any advice!

  1. Green Card takes a sponsor (employer). Being here illegally, if he gets caught and deported, can add 10 years processing time for any other visa.

    For a Spouse Visa, using a legit passport, you have to prove income for the last 3 years was above the Federal Poverty Guidelines. For a family of 4, that's $21,200 annual minimum income.

    You can try Catholic Family Services, or the advice of an attorney specialized in immigration issues. The CFS organizations have an overworked volunteer attorney usually.


  2. The only way for him to become legal in the US is for him to return to his home country and start the application process the legal way. You will not be able to sponsor him, because you are unable to support yourself and your children without government assistance.

    I recommend an immigration attorney.
