If I travel to the US as a tourist and has a pending petition for immigration, will this have any effect on my pending petition?

  1. As the beneficiary of a petition for immigration purposes, it might be very difficult to convince a border officer that your proposed trip is of a temporary nature. There's a chance you may be viewed as someone who is trying to speed things up by coming to the U.S. as a visitor and then trying to adjust to permanent resident after arrival.

    If I was a border officer, I'd be reluctant to admit you as a visitor. It would be much safer from my viewpoint if you stayed in your home country and waited for the immigrant visa.

    However, if you could convince me that you will absolutely, positively return to your home country after a short trip to the U.S. during which you would not work, I might admit you, but it would be easier to send you back.
