We have been dating since mid December and I was there in Philippines in June. We have pics together, video, email logs and phone bills for proof that we are a couple. She is 6 weeks pregnant and I want to see what the best way to obtain a US visa for her and our soon to be baby will be. She also has 2 sons from a previous relationship that will become my step children after our marriage. Any input on this is greatly appreciated. Thanks!

  1. Contact a real immigration lawyer and don't do anything without legal advice.

  2. Contact an immigration lawyer. Also I think you 2 should get married first.... have pictures taken, and alot of them! Then take all your proof to a lawyer saying you would like to be close to you WIFE!  That'll help out alot more! I hope I helped!

  3. Please check into the K1 fiancee visa. The matter could become slightly more complicated, depending on whether you could get her here on a visa before she gave birth. If she is 6 weeks pregnant you might still have time to process the visa before she gives birth.

As far as her other children, they could receive "derivative K-2 Visas from her approved I-129F petition." assuming they are not adults yet? They must be included on your I-129F petition to be eligible for these visas. A separate medical exam and visa fees will be required for the children.

One note of caution I will mention. It is very common for women with children in the Philippines to be "legally married" even if they are no longer with the father. If this is the case, an annullment of the marriage would be required BEFORE you can file the petition.  There is no divorce in the Philippines. An annullment is a long and expensive process.
