I am a US citizen and my husband is a illegal immigrant????

I have been married for 5 years with my husband we have 2 angels together, he entered US illegally but i am a citizen is there any one with advise or a similar situation as us? W e have a attorney but his solution for our case is to leave the US and have him stay in his coutry until the case is app,ro,ved, In m,any cases we heard it takes up to 2 years to actuall,y come back into the USA., ,please help me>?????????

we are doing everything we can ju,st to some what l,i,ve a normal, life,,,, please advise me??????

  1. Your attorney is correct. He has to go back to his home country and you have to petition for him. He cannot change his status while he is living in the USA illegally. Being married and having children does not change that.


  2. If you have an Immigration lawyer, does not make any sense to ask for advice here.

    The only thing you can try is to consult another attorney,

    why did he come here illegally ?

    Is it so difficult to do thing in the proper way????????

  3. i had to answer this. Everyone here, including your own attorney gave you bad advice. If he leaves the country, he wouldn't be allowed to come back to the US for like 30 years or more. Just thought you might want to know that little fact.

    All you need to do is file an "Adjustment of Status for him" Ours took about 2 years.

    Oh, and get a new attorney.

  4. Illegal means you aren't suppose to be here - you are breaking the law.

    If your husband stays, he risks being deported and not being able to come back. Leaving is his only option.

  5. Unfortunately the lawyer is right, it doesnt matter how many lawyers u go see they will all have the same answer. If your husband entered the US illegally he has to go back to his country and file from there. what u can do is file the I 130 application now and he can stay here til its approved & he gets an interview in his own country-usually takes about 1 yr to 18 months to get an interview. if the marriage is legit u shouldnt have a problem getting approved.Then from his country he would have to file a waiver & wait for another interview so they dont punish him for 10 years, this is where u have to wait the longest for approval.     Time to deal with the situation in an aboveboard and straightforward manner.

  7. Sorry but the only option you have is for your husband to return to his country and apply to come here BEFORE he gets caught and deported. If he gets deported you will have a huge problem.  He won't be allowed back into the country.

    Being married to a citizen may shorten the time he waits but that doesn't give him an auto pass into the US.  Save your money - skip the attorney.  

    Sorry but that's the law! I know you don't like this but your husband is a criminal since he is breaking the law. That the FACTS of the situation. He broke the law by coming here illegally. You can't have a "normal life" since he's breaking the law.

Yes, he needs to go back to his own country and apply to come back legally.  There is nothing you can do for him until he does that.  No short cuts.  It will take several years, but definitely there will be a 10 year ban if he is apprehended and deported.  You and your anchor babies could always go to his country to wait it out.

  9. I am sorry this happened. U should consult another lawyer for second opininion. Sadly hysteria and xenophobia are rampant at this time. Personaly I have no problem with people who come here for better life and wil pray u can find solution

Your husband will have to leave the USA and wait for a visa in his country of origin.You will have to file an I-130.Chances are that since he entered the country illegally,his visa will be denied and then you will have to file an I-601 waiver of inadmissability.The I-130 takes 6-9 months to get approved.
