I am a Wal-Mart employee , today i was denied a 15 minute brake by the manager and i recorded it can i sue?

im a wa-mart employee and had been working 6 hours straight and the manager denied me a 15 minute brake which is illegal in new york state . and i recorded when he said it can i sue wal-mart ?

  1. talk to your store manager and let them know - if that doesn't help call the market manager so that it doesn't happen again. I doubt you'll find a lawyer that will take a case over one 14 min. break - and what did you do anyway?  Walk up and say "can I take a break"?  Why would you do that in the first place?  You're responsible for when you take your break - management doesn't have the time to walk around the store of 100's of employees who start at different times and tell everyone when to take a break.  If you're in a position that requires someone to be there then you need to let a manager know that in 10 minutes I am due for a break - can someone cover my area?  If there isn't no one to cover then you just go.  It's the law so you take your break.


  2. You won't be able to sue for that much, if at all. It would be better to talk to your manager's supervisor and complain to him or her, telling them your situation and how it is illegal in NY. They will most likely give you something to compensate as well as reprimand your manager (hopefully).

    Maybe you could get a different job, if that's an option. Nobody should have to work that long without a break.

  3. They're not required to give you a brake. They are, however, required to give you a BREAK.

  5. no you cant sue (that i know of)...however you are required by walmart corportation to take your lunches and breaks,by the way if you worked 6 hrs straight and were refused a lunch break,that is against labor laws as well,i would first go up your chain of command first,have you talked to your store manager,merchandising manager ,district manager or called 1-800-walmart..yet?start with them first..

  6. If you are so anxious to spend money to sue them for a 15 minute break - it is time for you to quit and find another job.  If you aren't full time, they aren't worried about you.

    Save your money, go find another job then just dump them without 2 weeks notice.

  8. Tell them to **** off and then go get a job where you are represented by a labor union. Trust me, when you are in a union this kind of thing DOES NOT happen.

  10. You can lodge a complaint against the manager with H.R. department of Wal-Mart, and you can contact the NYS Department of Labor (they have a website).

    Can you sue?  unlikely - can you prove that you were in some way injured or damaged by missing a 15 minute break?  How much money do you think a jury would award to ease the pain and suffering you enduring during your 15 minutes of additional work?  Just try to find a lawyer who would take a case based on your evidence.
