I am a real estate Personal assistant. Dose that mean I'm self employed?

Also, I have no contract with my job that is why i am not sure about this.

  1. Who pays u? Do they take the taxes out or not. Just cause there is no contract means nothing.


  2. Working this out can be confusing. There are many factors to consider such as; who is paying the taxes for your earnings, if so is it PAYE or WT tax, do you work from your site or theirs, do you invoice for hours etc.

    If they are paying PAYE from your wages and you are working on their site you would most probably be an employee. In that case even though you don't have a contract you come under the minimum standards as set down for employment contracts by the DOL (www.ers.dol.govt.nz).

    IF they aren't paying any tax on your behalf or paying just WT and you work at your own site, then most probably a contractor.

    Just ask for a copy of your payslip and should identify how you are being paid.

  3. You are self employed if you pay all your own taxes and insurance.

    If your  boss pays these things you are employed. If that is the case you should have a contract of employment.

  4. Self employed means you are the boss, people are working  for you and you are paying them for the job they do for you. If you are working for someone else as a personal assistant and he/she is paying your salary, then you are not  self employed.
