Can he stay in US while waiting for for the petition to be approved?

  2. With marriage in the US you have just furnished immigration with solid proof that he was in the US illegally.

    The repercussions can be enormous. He could get a ten year ban and fixing that could take years plus much money. Say you had a petition while he was in the US. He will not be able to work. You might think he can still work on the side but the interveiwer will look into your finances.

    The cheapest and safest way is that he returns home and you then petition. The up to two years to get it through are better than never getting approved.  

  3. Unfortunately,he will have to return to his country and wait for a visa.You will have to fill out an I-130 on his behalf and most likely an I-601 waiver because he was here illegally.This will take at least 2 years.

    He must return to his country while waiting.  

    Also, if you married him here in the US, it could be considered (used against you) as proof that he was here illegally, and that would keep him out of the US for 5-20 years.

    Please be careful and speak to an immigration attorney before you tell ICE anything that could cause you trouble.

  6. Yes you can petition him, but he must return to his country to re enter under your petition after he submits and complies with all of their request. This could take up to 2 years.
