Question:

I am a victim of Identity Theft and have not been able to gain employment due to this. I feel its disability

No company will hire me due to my background results because of Identity Theft and I feel that I should be able to claim disability or a monthly compensation to make up for this since it is due to a certain states negligence.

Sorry, Identity theft is not a disability.  There is no sickness for that.  You must get all the info together and when you interview you might say that you have been a victim of a crime and explain to the interviewer.  Tell them that you are working it out and the case is still under investigation.
