I am a visitor, soon getting married to a US resident?

They say I need to go for court marriage first, what documents do I need? what to wear? (I am a Muslim) What would be the requirements of INS? What documents do I need with me that day?

Plz guide me. Related hyperlinks are welcome.

  1. you need to add more information as what is your nationalty?(what passport did you use to enter the united states as in of what country) how much time are you in the states? is the marrige real?


  2. Marriage is a state thing. If you are over 18, you can take your passport and your hubby-to-be down to the local courthouse to buy a marriage license. Go find the religious clergy services you want to use. The clergy and a witness will sign the marriage license with you. You return the marriage license to the courthouse to be recorded in their records that you are now married.

    Then, you will need to go back home to your country. Marriage does not automatically entitle you to Residency. You and your new husband will need to file for a Spouse Visa. Takes about 2 years. Do not overstay your visitor visa, that will delay your Spouse Visa a great length of time.

  3. If you are here on a tourist visa/visit visa and you get married, you will be automatically flagged for a visa fraud/marriage fraud investigation.  You should go home and wait for him to get you a fiance visa.  It will take about a year.

    If you go ahead and get married, you need your birth certificate and passport to prove that you are of age.  For a court marriage, wear a nice suit or dress.

    You will have to return to your own country while your new husband applies for a spousal visa.  If he is a US citizen, it will take at least a couple of years.  If he is a legal permanent resident (permanent green card), it will take at least 5 years.  He has to prove how and where you met, how long and how well you know each other, when and where you have been together -- in short, prove it is a valid relationship.  He also has to prove he has sufficient income and assets to support you and guarantee a $30,000 bond.  You are going to have a very difficult time proving this is a valid marriage, especially since you will not be able to live together as husband and wife during the visa processing, fraud investigation.

  6. All you need is your passport.  In the United States nobody, and I mean nobody, is going to care what religious faith you are.  Marriage is the same for all of us.  The law is the same for all of us.  We don't have second class citizens here.

    IF YOUR HUSBSAND IS A US CITIZEN......

    After the marriage.....

    The US citizen files I-130, I-864 and G-325A for the new spouse.

    The foreign spouse files I-485, I-765 and G-325A.

    File all 6 forms in the same envelope, at the same time.

    In about 90 days or less the foreign spouse will get a work permit.

    In about 6 months the foreign spouse will have an interview with USCIS.

    In about a year the foreign spouse will get the green card in the mail.

    If you need to "go home" you, the foreign spouse, must file Form I-131 with the USCIS. Try to file at least 90 days BEFORE you leave the USA. DO NOT LEAVE WITHOUT FILING THIS FORM OR YOUR CASE WILL BE DROPPED.

    IF YOUR HUSBAND ONLY HAS A GREEN CARD....

    After the marrige you must leave the USA.  You cannot wait here.  The wait, in your country, will be about 5 and 1/2 years.

    The Green Card spouse files I-130, I-864 and G-325A for the new spouse.

    You'll be notified in your own country when it's time to get processed for your visa.
