I am an italian citizen I'd love to know what rights will have my baby if he'll born in the United States?

I'm a journalist and I'm here in the US with a regular visa. I got pregnant and I was wondering what will happen to my baby if he'll born here. I think I'll be here since I'm working on a long term project for a tv. Will he has some kind of rights because he'll born here like dual citizenship? How does the thing work?

  1. Your baby will have the right to Italian citizenship, same as you.  It will have rights to citizenship based on its birth in the US as well -- it will be a dual national until age 18.

    Note:  if you do not claim your child's right to Italian citizenship on its behalf, then even if your child returns to Italy with you, it will be required to pay US income taxes on worldwide income!  This is a BIG problem many foreigners fail to consider regarding their children!  "Income" need not wait until baby is old enough to work -- it includes interest and investment income, etc.

  3. Any child born in the USA is a US citizen regardless of the status of it's parents. He will be protected by the United States Constitution, and is entitled to the same rights as any US citizen.

  4. He will have two citizenships: Italian for being born from an Italian parent (but be sure you register his/her birth at the nearest Italian consulate) and American for being born on american soil.

    As an Italian citizen, your child will have the right to live and work in any member country of the European Union, and be entitled to free medical care and social assistance.

    As an U.S. citizen he/she will be entitled to live and work in the U.S., and will be eligible to run for any public office, included the top job. However, forget about free medical care (unless you live in California and earn below a certain yearly amount...).
