I am being sued for an old car accident and i had insurance?

I was in a car accident close to two years ago in sep of 06 and one of the passengers was not wearing a seatbelt because they were in the back doing "things they shouldn't be doing" and thus flew out the front windsheild.. they ended up in the hospital and sued my insurance company, i thought this was all settled and now i come to find they are suing ME personally and my grandmother (she wasn't even in the car, but my insurance was under her name) neither of us have any money nor do we own any property, we barley manage to get along, what can we do? are we in danger?

i dont see how they are suing my grandmother since she wasn't even in the car and the car was under my name.. only the insurance was under her , but i was a secondary driver?

It does not make sense that they sued your insurance company, and now you.  They probably put a claim in with your insurance company, which was not paid, so they are now suing, so they sue you, not your insurance company.  This is b/c your insurance company has an obligation to you, not them.  

Now that you have been sued, you must forward this to your insurance company immediately.  Call them, then fax and mail it to them.  The insurance company must defend you, and indemnify you up to the policy limits.  If you do not send it to them promptly, they will have grounds to disclaim coverage, so waste no time.

Generally speaking it is up to the driver to ensure all passengers are wearing their seatbelts. I know where I am living if a passenger is caught without a seatbelt the driver is fined aswell as loss of points and the passenger is also fined. This is a rediculous law but thats the case. Personal injury to your passengers should be covered by MAIB and if that fails you should have had $20mil liability automatically included on your Grandmothers insurance policy to cover this, I would consult your insurance agent.
