I am british citizen living illegally in the usa. i am married to a u.s citizen & we have a 20 month old son ?

who is also a u.s citizen.

my husband & i want to go & live in the United Kingdom now.

I no longer want to be here and my husband wants us all to move to my home country.

I just want to know, since i'm out of status, will i be arrested if i try to leave the country?

when i show up in customs with my husband & child what will happen.

I just want to go home.

  1. I believe you will be able to depart but will not be able to re-enter.


  2. I don't know much about immigration and all that..... but honestly what would be the point in them arresting you if you are going back home? Wouldn't it save them the trouble of having to deport you anyway?  

  3. well when u leave the states there is no passport control and u will usually not be bothered and even if u will they usually let ppl out of status leave the US rather then arrest them.

    but make sure that ur passport is not expired as it will make the entry to the UK more difficult.

    also be sure to apply for a British passport for your son which is a British citizen by descent.

    and also apply for an spouse entry Clarence for your husband.

  4. You can leave on your own using your money or they can deport you using our money.  Since you are doing it on your own I cant see why they would stop you.

    They just wont let you come back.

  5. The US will let you leave, just purchase your tickets and fly back to the UK. The questions you should be asking are related to UK immigration law. He will need a UK Spouse Entry Visa granted before entering the UK.
