I am buying a house, that has tenants living there?

the owners told them on the 1st that they had a offer on the house how long do they have to get out? Im selling my house and closing on both houses will be on the same day. I need to be able to move into my new house please help I live in Indiana

  2. if they have a lease that is still in the 12 months, and there is no clause in it for the sale of the house - they are entitled to stay - you or the seller might have to offer them money to leave early-ask the seller what the tenants response was

Usually tenants have 90 days to leave after 'proper' notification.  I'd contact a tenants rights group..they would have the right info.  If you were to offer incentive..help finding a place, help moving, pay storage for two months on their possessions....  I'm in NY and the laws may differ...I'd keep it as proactive and positive as possible..good luck!

The lease signed by the renters go with the house.  If it is month to month they have a month once notified.  If it has a specified time duration they have until the end of the lease unless there is a provision in the contract breaking the lease if the home is sold.  The rental lease goes with the home not the owner.  Just be case the home changes hands doesn't break the lease.

    This is something YOU NEED TO CHECK into before you close.

  5. First I will check with your state law , second find out when the tenant's lease is up . Did the seller made you aware before that the house was tenanted ? I would seek legal advise before I actually close , because your sole purpose is to move into your house which you have or is going about to own in the near future.

  6. Just because the house is being sold doesn't mean tenants have to leave.  Their lease with current owner is transferred to you.  If it goes to December 31, they can stay until then.  Have you seen lease?  Do you have an attorney?  

    Telling the tentants they  have an offer is not the same as giving them notice to move out, that their tenantcy is terminated.  If they have no written lease, they are on a month to month lease which requires 30 days advance notice, 30 days from date rent is due, thus notice now means they would have to be out at end of August.

  7. does the contract on your new house have information about the current tennants?  Probably the lease the tennants have with the current owners talks about them having to vacate the property by closing date in the event of a sale, or something like that.
