Question:

I am fighting for my three year old girl How can I remove all rights for her father to visit her

I have been in the care of my three year old sence the day she was born all she has ever known is mom/me ,for two years her father in the home had nothing to do with her and was realy abusive to me her and the other three children of his I have witnesses but they can only do a phone thing for court being they cant make it due to health and distance issues, I do have their statments. Sence seperating almost a year ago she has always been with me and he has made no attempt to help out or see her even when I first tried to bring him into her life now after the court temporarly oredered him to pay child support he wants full visitaion. She is scared of him and remebers I have a lot of stuff but nothing that is complete and a lot of patchy stuff but it is all good evidence and he does have a past history with abuse and social services dealing with him because of his temper and abuse to his other kids. How can I strip all rights away from him until she is old enough to make the decision on her own. when he wont budge any which way please respond soon. Thank you.

  1. Your best bet is to speak with a lawyer they will have more information on these kinds of cases than anyone. If you can speak with a social worker as well they might be able to explain to you some of your options before you talk to a lawyer.   2. Sounds like to me you are being mean and the only person you are hurting is the kid. I also think that if you knew he was abusive why where you with him in the first place.

  3. talk to your lawyer. its very hard to prove almost impossible and now days the judge thinks that two parents are best for the well being of the child. it makes no difference what hes done or what little stuff you have it so hard to prove we Have similar instance with the mom shes a prono queen and she still has visitation rights even though she goes to her step grand moms and a woman that also was found out abusing her and her own kids. but that makes no difference i know first hand i am a grandma. you just have to get a really good lawyer and one that has guts to fight and you also have to have visitation  like maybe where they have to be watching her and him. its unreal but you have to be careful what you say to judge or they will say you are the problem i know what you mean but hey this is something else now days with custody and visitation.

  4. Since the laws differ from state to state its really hard to say what might happen but You can go request a drug screen testing and also have the court records in hand on the past abuse and make sure the courts has all the legal important information including the papers on the other children and anything else you might know about him a criminal check of his behavior etc. You can also request anger management and parenting classes before he can have visitations and if the courts agree from what you say about his past i doubt that he is willing to go through classes and testing just to see her since he never wanted to before this i think he is bluffing hoping you will ask him to sign his rights away and to void all child support for her or the others. God Bless I hope it all works out for you and your children sad when all a parent wants is to cause undue problems to get revenge on the other parent when children have to be the ones hurt.

  5. If he didn't want visitation rights for so long, and he was abusive, with the testimonies from your witnesses that should be enough for a judge to take away most of his visitation rights. But since he is paying child support they may want to give him some rights. However, you can ask for maybe only visits to your house where he is not allowed to be alone with the child or with the child when you are not there. I'm not sure they will take away all rights if he is paying child support.

  6. say that he is a danger to her, and get a restraining order
