  2. Yes, you do. If your husband is in a foregin military it will make no difference. If your husband is a US soldier he had to have registered his marriage with the US embassy and your marriage is legal in the US.  But the question still remains open for your son. Your husband should have obtained a US passport for your child. In that case the boy is free to travel to germany without a visa. If your husband failed to do so. Than you may appliy for a passport on your own at the US embassy.  If he signed your son's birth certificate he should be a recognized american citizen. You should have no problems and can kill time while you wait for your own visa.
