I am in US for the last 1 year. I have zero income in india. Do i have to file tax return in India?

  1. If you are a resident of India than it will be required to submit the Return other wise it will not be required ( You can also file the return if you are a non-resident as there is a option available in the form for Non-Residents )

    If you are a resident than you have to file ITR-2 form in Income Tax Office because the ITR-2 is that form which is filled by the persons whose income is not from any business or profession but some other sources or zero income.

    In my opinion you must file it.

  2. If you are a Citizen of India, then yes you need to. If you already have been taxed, the same can be shown in the ITR.

    The residential status for the Income Tax Act is determined in section 6 as under:

    An individual will be treated as a resident in India in any previous year if he fulfills any of the following two conditions:

    (a) he/she is in India in that year for period or periods amounting in all to 182 days or more, or

    (b) Having within the four years preceding that year been in India for a period or periods amounting in all to 365 days or more, and has been in India for 60 days or more in that year.

This question is probably better suited for the "india" section.  I can only tell you that in the US you are generally only required to file a return if you have earned income over a specific amount for the previous tax year.  Earned income can include not just regular wages, but lottery/gambling winnings and certain government funds such as tax refunds from previous years.  My assumption would be that with zero income in India for a full tax year you would not be required to file a return.  However your best bet will be to ask a financial adviser in India.
