  1. the photos, regrettably prove nothing, they could have been taken at any time and wont show when it was resprayed

  2. "Criminal" means you're being prosecuted by a government agency, like the police, FBI, IRS, state tax authority, etc...What you have is a civil case, meaning you have a dispute over who is going to pay for property damage, or any damage than can be compensated by monetary compensation.

He has to prove you damaged his car, either by witness, or video surveillance.  If you don't have a mark on your car, take a picture (or video) of the front bumper of your car, showing there are no marks. If you had hit his car, there should have been visible damage on your bumper.

You're in a civil court, not criminal court. If you're in a criminal court, you'd either be in handcuffs, sitting in jail, or have received a summons to appear in court to face criminal charges.

  3. Your photos won't prove a thing.  (Bloke here last week went inside after running a lad down and driving on.  He had the car repaired to show no damage, nevertheless he was traced and additionally charged with attempting to pervert the course of justice.)

  4. Have you sought advice from the Citizens Advice Bureau?
