Question:

I am looking to adopt a child placed in my care from CPS , mother is in anthor state , any suggestions ?

The mother has no interest in the child , she has not seen her for more than two years , attorneys tell me that the mother needs to appear in court ... but she wont she is afraid that cps will take her 4 th child from her , 2 other children have been taken from her as well ... She moved to another state to give birth to the 4th baby, now 9 mo old . I have baby # 3 , since the day she was born , and the mother gave me legal custody when she was 5mo old . then walked out of her life , She wont come back to this state to consent to adoption , And wont pay any support even though the court ordered her to do so more than a year ago .

  1. WOW!!! Why have more babies if you don't want the ones you already had!?

    I think that attorneys need to go to court and figure out a way that you can adopt this child....  If this child is in your hands from CPS then why would it be such an issue for you to adopt!? How long have you been caring for this child?!


  2. Laws concerning adoption very from state-to-state. Without knowing where you are at, I can't really tell you what might help.

    For any adoption to be legal, the birthparents must consent to the adoption unless their parental rights have been legally terminated for some other reason. In some states, the consent can be in writing and having it notarized. If the birthmother does not want to go before a judge, maybe she would consent to a notarized statement.

  3. depending on the state the support will catch up with her. i know its not much of an answer but pray that things will work out for the best.

CPS should be able to help you with the adoption since she was removed from her home.  Yes the biological parents are suppose to appear in court and it can stall adoptions if they don't but in the end most adoptions still go through and sometimes the judges grant the adoption because the parents are a noshow as long as you show proof that you have tried to contact them and that they haven't had contact.  A good lawyer can find loopholes around her appearing in court so the courts can just take away her legal rights making you able to adopt the child.  If yougot her through CPS or your county agency they usually find ways to get the children adopted without parental consent.  Good luck.

  5. Is the birth mother willing to sign paperwork if she does not have to come to court?  If so, you may be able to contact a private adoption agency in your area and they know the legal paperwork to complete the adoption.

    You did not mention the father and whether he is around.  If he has not relinquished his rights or had them terminated, he will also need to be a party to the suit so that you can complete the adoption.  If the father is unknown, the attorneys can complete paperwork to clear that up too.

  6. was the child placed with you by cps...or by the mom?  it makes a difference. Cps should be able to help with adopting. they did for us. Nation wide law is if the child is in foster care for 15 months then cps can terminate parental rights and allow the child to adopt. If she refuses to return for court they will grant the tpr anyways. But definitely talk to your caseworker and let them know you are interested in adopting. there may be classes and lots of other things you need to do to become a certified adoptive family. You'll want to be approved before the termination happens or the child could be adopted by someone else.  Where is the father in this situation?

I had the same problem through DCF I actually have child number 3 also.  She went out of state to give birth to the gourth one but the state actually found out from the hospital and they took that baby also.  However the birth mother did not want anything to do with her first 3 as she was in a bad place at the time.  I got my son when he was a few days old and the adoption was not finalized till he was 16 months old because of the same reason they did make her appear in front of the court and then I was able to adopt my son so I don't really know if there is a way around if she does not want to go to colurt but I wish you the best of luck!

  8. i am a foster parent i believe by now the children should be ward of the state and should be able to be legally adopted!!!!!!!!!
