You should engage a lawyer for this work as since the registration of marriage & issuing of the valid marriage certificate by the Registrar of Marriages requires the presence of both parties to marriage along with two of more witnesses, but in your case your husband is not available for the registration of the marriage & in his absence the Registrar of Marriages of your District may refuse to register the marriage. The lawyer may be able to convince the Registrar for this as there is a Delhi High Court judgment on this subject where the Husband was not available & to get the Registration of the Marriage under the Hindu Marriage Act, 1955 the High Court had laid down certain principles which could be followed by the parties & the Registrar of marriages to register the marriage & issue valid marriage certificate. Since this case relates to Delhi these Principles laid down by the Delhi High Court will be binding on the Registrar of Marriages in Delhi territory. How far these can be followed by Registrar of marriages in any other state depends how the case is handled by the lawyer in convincing the Registrar of Marriages there.
