I am nurse.I am in B1B2 in usa.I want to prepare Nclex.can i get F1 visa if i apply ?I have I 20 from Kaplan.

hi am in in usa as B1B2 visa.I found Kaplan institute.which is going to help me with NCLEX preparation.And they are ready to give I20.is there any chance to change my visa into F1 from B2?

I work in an international student office at a major university in New York.  It IS possible to change your visa status from one status to another but if you were my student, I would not advise you to apply for a change of status to F1 in the U.S.  I'm kind of surprised that Yak Rider advised you to do so....  

    Most of my students would like to travel outside of the U.S. for tourist purposes or to visit family while they study so travelling to get a F1 visa and then entering the U.S. is the best way for them to change their status.  Changing your status in the U.S. by filing an I-539 and getting approval, will allow you to stay and study in F1 status but it will NOT grant you an F1 entry visa.  Entry visas are only issued outside of the U.S. Kaplan's international student advisor can explain the difference between F1 status and an F1 entry visa to you.

    Filing a change of status in the U.S. from B1/B2 to F1 is usually denied in my experiences since 2004.  I have noticed that students attending smaller schools than mine have been successful though.  Did you mention that you were planning to stay for NCLEX training or any other schooling when you applied for your B1/B2  entry visa at the embassy?  If your answer is no, then your change to student status may be denied since you supposedly entered for tourist purposes.  You'll need to clearly explain why it would be inconvenient or difficult for you to travel home to apply for a visa.

    If your answer is yes, then you may have a successful application because the USCIS will consider you a "prospective" student since you declared your intention to study before entering the U.S.

    Your financial documents will need to be solid and you should write a very good explanation letter if you decide to proceed with a change of status application in the U.S.

  3. You can apply for a change of status from a B nonimmigrant classification to F-1 inside the U.S. if you are maintaining status and your I-94 has not expired.

    You won't actually receive a visa. You won't get a new visa stamped inside your passport, but you can apply for a "change of status."

    Use form I-539 and submit the proper fee and supporting documents, which will be listed in the instructions on the form. You may not begin studies at Kaplan until your application is approved.

    Yak rider is correct. All you need to do is file Form I-539 and send your I-20, original I-94 and proof of funds to pay for both your tuition and living expenses.

    The form can be downloaded from the link below and it will cost $300 to file.

  5. F1 student visas must always be applied for from your home country.  You cannot change status from a tourist to any other sort of visa.

    You have your I-20, take it home and apply for F1.  You will need to prove you sufficient funds for all of your school expenses (tuition, fees, books, etc) and all your living expenses, plus transportation home upon completion of your program.  You must stay in your home country until the F1 is approved, then you can arrive within 30 days of classes starting.  You will have to leave within 30 days of completing or terminating your studies.
