Question:

I am out of status in the U.S but need to renew my Malaysian Passport (expired years ago). What do I do?

The Malaysian Consulate in the U.S requires a copy of Valid Visa for the renewal process (my H1 expired years ago when I lost my job during the economic crisis in New York). How do I go about getting my passport renewed? Would the Malaysian Consulate not approve the renewal or report me to the U.S Immigration?

  1. You must understand that your embassy or consulate, has nothing to do with the US immigration when it comes down to renewing your passport from your Country if from around the Illinois try this link http://mangalorean.com/news.php?newstype...


  2. If you're a U.S.legal resident,then you shouldn't have any problem renewing your passport and if you lost your job for any economic reason it doesn't mean you loose your immigration status in the U.S. but I do believe you have over stayed your visa and

    as a result you have became undocumented person and the only way to leave the country is to ask your consulate to give you traveling paper as a replacement to your passport to allow you to travel to return to your country only .

  3. If the Malaysian Consulate will not approve your passport request, ask them what you have to do.

  4. I have no idea what the Malaysian consulate would do, but they are under no legal obligation to inform US immigration if they find you are out of status when you renew your passport. Since you remain a Malaysian citizen whether you are in status here in the US or not, I don't know why they wouldn't renew your passport.

I know a friend who is in similar situation as you.  In order to renew a passport, consulate require proof of legal residence in US, so they are not going to renew it unless you fix the first problem, unless that you want to leave United States.  In order to leave the US, your embassy will provide you with a travel document, after you have proven your identity to them somehow, and it can take some time.  If you want to stay in US, you need to somehow become a legal resident.  Do you have a copy of your passport and original I-94 (the document that is attached to your passport on the first entry to US) ?  So that you can prove at least a legal entry into this country.  And if so then you need to seek help of a good immigration lawyer.  Immigration forms only require copies, not the actual passports at the time of applying for a status.  And once you get your status you can apply for the passport from the Malaysian Consulate....

  6. the only way to renuw it is to retun back in status    all foreigb consulates  will want to see that your living accordngly  in the USA    for this reason they will never  renue your  passport   you cna however ask for  a travel document to board   an flight   back to your country   only problem  is that you will have to pass  passport control  and ICE may detain you for short time  so they can issue yopu  a never come back letter  they way i see it  you're little SOL
