Question:

I am out of the country. i heard there is a civil warrant for me. will i go to jail when i re-enter ?

what is the process of a civil warrant? i filed bankrupcy then when i lost my job i couldnt pay the ch.13 payments. eventually i left the country. now i want to re-enter the us if there is a civil warrant for me can i go to jail and will i be able to refile the 13 to a7¡?

I'm not familiar with the term "civil warrant," but if there is a warrant for your arrest, you will be detained at the border AND if it is a felony matter, you will be extradicted to the warrant issuing State...if it is confirmed the State still wants you and is willing to pick you up from custody.

    EDIT:  based on your information, this is a Federal Court matter and is a warrant for failing to appear in court or failure to comply with a court order.  The Feds will detain you and will pick you up.

    You may try to resolve this ahead of time and arrange a surrender via your attorney or a Federal public defender.  Contact your district's Federal Public Defender's Office for assistance.

  4. Well, I'm I don't know about Mexican law, but if you have a warrent here in the US and get stopped by an officer, and he runs your name and you come back with warrants out of where ever, you go in.

A CIVIL WARRANT if there is any is different from criminal warrant, you have civil liability meaning you owe somebody an amount of money and they file a case against you so the court issued a warrant but not to arrest you but to obliged you to pay the petitioner, but I do not know who is. Somebody is running after you for that amount of money, so either you show up or run, the more you run the more a new case will be file against you these time it will be criminal case.

    IN A CIVIL suit you are not required to be jail, but your property is at stake, the court can haul all your asset including those in the bank if you have any. Once you enter the US, you have no outstanding warrant but once your received these warrant you have to go to court otherwise, these case will elevate to criminal one.
