I am the sponsor of my son, he is older than 18 and married to an USA citizen. Is that permited?

My husband and I are U.S. citizen and we fill the INS application to sponsor our son, so he can receive the green card or residency permit.

  1. He might get it faster as the spouse of a us citizen.  Marriage tends to mess up parental filings for visas, but if he is married to a US citizen, that is usually the fastest way to go.  I don't know your circumstances, and you may be in an unusual circumstance, however.  

    If you are saying you are the financial sponsor, only, not a visa sponsor, they are just going to care about whether you are good for the money, typically.




  2. If your son is married to a US citizen HE SHOULD FILE WITH HIS WIFE. It is faster. The INS or now the home land security will require someone to show financial support on paper, you may do that for him, but the original application need to be with his wife, especially if he is over the age of 18


  3. It will be faster to if his wife petitions for him, and since she is a citizen, every thing will go through in as much as 6 months, in other words, 6 months after she puts in the application for him, he will be a legal resident. You can offer an affidavit of support, to show that he has sponsorship and will not become public charges while in the United States. He has to prove that he can get support over 125% above the mandated poverty line.

  4. Well, if you file a petition for him, it will be an F3 petition, which will take a minimum of 6 years to process. If his wife files it will be an immediate relative petition and will take over a a year, if he's overseas., but that will still be very fast compared to your petition. If she's overseas with him it would be even faster if she files directly at the US embassy, however, that's usually limited to Americans who are residents overseas.
