I am a witness to an assault and due into court to testify I do not want to do so and I want withdraw my witness statement can I do this? and am I inclined to go to trial eventhough I think I may have exaggerated a little in my witness statement?

  1. Unless you are dismissed by the attorney who issued your subpoena, you must go. Failure to show up could result in charges for contempt of court.

    Contact the attorney who issued your subpoena, and discuss your concerns with them. They would rather hear it now than in front of a jury.


  2. if you were given a letter a supena, then you have to go no questions asked at the above date and time and yes, location. unless there is any resonable reason you should not go, due to threat to life or to property, or financial hardship etc... then you have to go.

  3. By any chance is your name John McCain? That was a very cowardly thing to do. If you were the victim or accused would you not want someone to step foward and tell the truth? this is a moral question that only you can answer. (I hope you can do better than John McCain)
