  1. Go to the following link to view and download a sample letter.


  2. The form is simple to fill out.   You need to write a SHORT, very short, explaination as to why you should not be evicted.   Your eviction summons should have a reason on there for the eviction, you need to dispute that.    You bring your proof of the dispute to the hearing.

  3. What state are you in?  If you are in California, the Judicial Council has standard forms (denial) here:

    Go to Form UD-105 (Unlawful Detainer - Answer).

    If you are in a different state, check with the local courthouse and they can sell you the form.  You can also check your local law library and they should have books on how to prepare the proper response.

    If there is no standard form, you can probably use the language in the California form, but put it on pleading paper.

    If you don't know what pleading paper is, go to this site:

    and you can find it there (it's a PDF).  Just insert a caption and change the court name, etc.
