I been going through custody battle with me ex since my daughter was 4 months old. How can I win my rights?

How can I get more rights to my child? I been screwed by the court system. I get 22% and he gets 78% of physical custody, how can I make it 50/50? We have 50/50 on everything on her but only the physical. She stays with him and I don't even get overnights with her.

  1. since it is odd that the father has more custody of a baby, I have to ask why.... what happen....?

    what ever reason he was given custody, fix it and/or change it and then get your lawyer to go into court and get more custody..

Chances are that happened because of something you did or are doing, such as physical, emotional, drug, and/or alcohol abuse.  Otherwise, you would at least have overnight visits.  Whatever it is, shape up and fix it.  Get help, take parenting classes, and prove yourself to be a fit parent.  That's the only way you're going to get 50/50 custody.  Good luck.

  4. It's hard to say not knowing more details. I mean for all we know there is a reason the court has given him more physical custody and not you. Otherwise there would be no reason for a court to not give 50/50.

  5. There must be more to this story than you are sharing. A judge will seldom give a mother only 22% ccustody unless you have some issues. No overnight visits...........only you know the answer to that.

    Take some parenting classes, go to rehab, clean up the trash in  your life..........fix the problems and then get a good lawyer.

  6. there has to be some type of reason you don't have any overnights?? usually drugs/alcohol will do it.

Sounds like you have a drug or alcohol problem.  There has to be a reason why you only got this.  My daughter used drugs and even though she says she is clean, I am helping my son in law get full custody of their baby.  I do not want him to spend one single night with her and her new boyfriend.  I love my daughter but the safety of my grandson comes first.  He doesn't have a voice and either does your daughter at 4.  Sorry, but sounds to me like you missed out on a standup guy with her father and she probably is better off staying put.

  8. Sounds rare that a judge would give the man custody over a child that small.  Sounds like we're missing a key fact here.  But, if not a lawyer would be your best bet.
