I been kicked out a house i have been renting on a month to month lease.. Rental law? Help?

I have been renting a month to month lease on an oral contract. However, the lady who I was living with attack me physically. I plan to file a police report. On top of that, she kicked me out of the house. I have all my stuff in there! I have been giving her checks continually for the last few months. Can anyone tell me my options? I live in the state of Nevada, by the way.

  1. If she attacked you then you should have called the cops then....why would the cops believe it if you didnt call them when it happened?? secondly, if you have an oral contract and its month to month...then she can pretty much throw you out whenever she wants....

    If she attacked you, why do you still want to live there?

    You need to find a new place and call an attorney.


  2. month to month is not a lease, and anything oral is your word against hers.  If you file a police report, you can ask for a "standby" to go with you to the house, to get your things.

    the question is if she owns the house or not.

You need to check into your law about self help lock eviction ( which is what she did to you) in most states it is illegal to lock and one out of their home with out being evicted from the court system, some states will awared you up to 3 times your rental rent you were paying.   make sure you have proof of paying your rent and anyone that can verify this.. you can take this person to small claims court for this and sue her for this. Please make a police report even if it is later. never hurts .

  4. If you can prove you have been paying her for the rent, File that Police report and ask if a policeman to go with you to the house.  She can't refuse to let you have your things back!  

  5. look up nevada landlord tenant laws . you need to file police report . and all was done on verbal contract which is fine but i am sure you have friends that would testify or tell cops you lived there . they have to give you your stuff . call cops And you say been giving her checks . there is your proof . she has to give you your stuff i would thin i know that is law in most states .  

  6. AHHHH the good old oral contract.  You don't have a leg to stand on.  Make nice and get your stuff back.  From here on out get it in writing.

  7. She cant legally hold your stuff. Thats stealing which im sure is illegal in all states. Get an officer to go with you to get your stuff and move on with your life. NEVER trust a verbal agreement because it hold no ground in a court.

  8. you're out of luck.  Ask her nice for your stuff, hope for the best and move on.  And next time sign a rental ageement.
