I booked a holiday, can I go?

I booked a holiday about 3 months ago,I informed my bosses of the dates and they said that was fine. Now a week before I go they have said I cant go due to someone being sacked. Can they do this and is it legal?

  1. wouldn't have thought so but tell them you'll going to citizen's advice and see if they back down


  2. Well, if you go on holiday and they sack you, you can then sue them for unfair dismissal, provided you can prove they agreed to your dates.

  3. If it was already agreed that you could go then if they say you really cannot go and you would lose your job then they should pay for replacement holiday and pay money back that you already paid.  I would let them know how much holiday cost and give them bill to cover your costs.

    If you really want to go then i would tell them that you are not prepared to give up your holiday as you are looking forward to it and have paid all the money.  If they still say you cannot go and you want to then take it up with your union or hand in your notice.  

  4. If you are in the UK, then your rights are determined by the Working Time Directive (unless your employer has more generous rules).

    (1) You must give your employer advance notice that you want to take holiday. This notice should be at least twice as long as the amount of holiday you want to take (for example, you should give two week's notice for one week's holiday).  You did this...3 months ago

    (2) Your employer can refuse permission for your holiday as long as they give you notice which is at least as long as the holiday requested (so to refuse a request for a week's leave, they would have to tell you a week in advance).  ....so if you have 2 weeks holiday booked, they are too late to tell you now, 1 week out.  But this is for the situation where they have not already given permission.  I can't find anything that confirms whether or not the employer can change its permission.

    Call the Citizens Advice Bureau or ACAS for advice if the holiday is only one week.
