I bought a house yesterday. The person wants more time to move their stuff out, and now holding up renovations

The former owner is taking too much time to get her stuff out of my house. We closed yesterday 07/21.

  1. Charge them rent.  Calculate an average per day cost until they move out.

If you want to be nice and its not in the way you can give them a little time to get rid of it.  Otherwise, just move it into a corner of the house and give them one or two days to come get it (or you'll drop it all on the curve).  They can go rent a storage space if they must but this is not your problem and you should not be put out by it.

  3. From what I understand you can charge them rent check with your attorney.

  4. You have the right to move it outside for them. But will one more day really matter if the large scheme of life? Give them some room, this may not be easy for them.  I know you're excited and want to get in and make it your home, but one day, 8 hours even will not matter 1 week from now. Right?

  5. She has two options. Get out (even if you need to call the cops as she’s now a trespasser) or pay rent. You legally own the property and have no reason to put up with this.

  6. If the clock is ticking on your mortgage I would consider charging her.  That is not fair.

  7. go back to your lawyer that handle the closing their should have been a rental provision for each day the old landlord stayed past the closing date, your lawyer should never have closed without some type of agreement on the old landlord staying past the closing date

  8. Each state is different.  However, you should NOT have settled until all the stuff was out and you inspected the house.

    If she is storing stuff, you could remove it, but you need to protect it.  If she is living there, then the issue is more complicated.  

    I would write her a letter stating that on (insert date), you will be removing all items to the street.  Also change the locks.

  9. You didn't demand fully vacated premises before you closed ?  Shame on YOU.  That was pretty stupid on your part.

    Depending on the laws of the state in which you live, you MAY have accepted her as a tenant if you allowed a closing while she was still in occupancy of the premises.  That requires an eviction process to clean up.
