I broke a restraining order and need help ...?

I reported a bar for criminal acts (drug trafficking) and the owner of the bar placed a restraining order against me to protect the business. I lost in the combating restraining order because I could not prove the alleged criminal acts. Stupid me ... I was in a major car accident where my car was submerged under water and the only person I knew was an employee of the bar - so I called. The owner reported my call to this employee - which was an infringement of the restraining order - and I would like to know what could happen. Once reported does the bar owner need to file charges? Or, is it now the decision of the county once reported.

  1. Well you need to talk to the person you called (away from the bar) and ask them if they will stand u for you and give you an official statement saying that were not calling about the bar. Also get copies of the police reports from you accident to back your story up.


  2. 1.  Your question is full of half-truths and consequently makes no sense.  In particular, unless you are employed as a prosecutor, you are not called upon to prove the truth of a criminal charge.  Instead, it appears you had some sort of vendetta and became a pain in the butt until they had to get a restraining order.

    2.  Violation of the order is a crime.  In my state it is punishable by up to six months in jail.  A third offense is a felony in my state, resulting in up to four years imprisonment.  

    3.  They don't want you there.  Leave them alone.

    4.  the decision to pursue a criminal conviction rests with the DA or county prosecutor, not with the victim.  That DA will have the burden of proving your crime.
