I brought mobile in subhiksha in ten dayit has low volume problem in ten days. who to file a case against them

the seal was not broken and i went to nokia customer case they replace me a mobile but it got other voice and other problem in diaplay. now they told me to wait for fifteen day for next replacement. i brought the mobile nokia 3500c for Rs 5400. but i used for ten days only. i want to file a case on subhiksha and nokia care. in subhiksha i told about the mobile problem he says fo Rs 5400 mobiles you wont get good product, if you need a good mobile you need to buy atlest 8000 or 10000. i have a doubt on subhiksha that they have sell me a damage product. pls give nesscary information to file a case against them.

    I think its your first experience with mobile problem.

    Subhikhsa is just a medium to deliver you product.As you are saying seal was ok,then no doubt about set is new.

    Moreover a all india popular store cant do mistakes like this..,

    now think for nokia.. Its handset problem.. Which may occur in any case.. As they already replaced you once,means they are working well. Nokia generally took around 2 weeks even for charger replacement,head phone or battery replacement... So dont worry. You will get your new mobile soon... I know its not a conditio to wait in excitement of new wait. What else we can do... Dont go in pangey of case etc. So chill and wait. You will surely get


  2. i don't think filing a case would provide you the mobile replacement before 15 days. i think you should meet the concerned officers of both subhiksha & nokia care and discuss the matter with them. warn them about filing the case and in case need arises send them a legal notice through a lawyer but filing a case in india would only make you poorer by a good amount of money as well as time. the outcome of case would not come before 2-3 years at least.

  3. Definitely file a case in the consumer forum against both Nokia and Subhiksha. I am appalled by the attitude of the people who say "chill out" or say "litigation is expensive". You have paid for it and you should be given a product that works - no compromise!!

  4. Well my friend, let me suggest you that at the very first don't go into any kind of litigations or cases. Now, at first try & settle the matter with them on the table, that is the only solution in a nice & good manner, as you will not get any kind of relief, if you go to a court & file a case against the company. The case will go on for years after years & the lawyer will mint his money through you, so be sensible & get your work out with sweet words, rather than behaving funnily & landing yourself into trouble, with your own kind of thinking.

  5. i havn't went in depth but as a title is clear about to file a case but i want to say only thing is that please go to the state consumer court with sufficient paper proof and ask for justice. also we know the legal work in India and may be the payable amount will be more then beneficiary amount so it would like loss making appeal!

  6. Slap the guy who said 5400 mobiles you wont get good product. You need to get your moneys worth even if you pay a ruppee. Call the manager and rip him apart, spit on his face if you can. These guys dont know to run the business. Their ship in Anna Nagar lost a lac worth of mobiles and they are throwing so much of attitude. Fight it out dude, create your scene, you have the upper hand. Sue them in consumer court.

Do you have a valid bill?  If so, go to the nearest NOKIA service center and make a complaint in writing, produce the photostat copy of the bill, and obtain an acknowledgment.  Make a clear cut and thorough complaint explaining the problems faced by you.  If they did not respond properly are get it replaced or repaired at their cost, then you can approach the consumer forum and file a suit for damages.  But before approaching the forum, you should have complained and the complaint must be clear and legal in all respects and the mobile company must have not attended and redressed your grievance to your satisfaction.  These are the prerequisites to file a compensatory suit with consumer forum.

  8. what nonsense the salesman has told you!! And its unusual tht a Nokia phone gave you such problems soon after you brought it- Nokia is the best co.

      I understand that it would trouble and annoy anyone ... tell them tht u doubt tht they have sold u an old product and they must replace it with a fine one otherwise you will file a case against them at consumer court. This might scare them and if it doesnt then you can sue them

    Go to the consumer forum in your city-- it will take just a couple of 100 bucks to file a case against them - do inquire of details when you first go - initially you will have to go twice for basic formalities --- then you will have to go on the date that they allot you to produce your documents etc and what you have to say and support your case ... finally you will have to go on the trial day ofcourse

    you will need a few things to support your claims as an evidence- eg- the bill of Subhiksha with date on it, then a proof of your complaint to Nokia and Subhiksha( you have to be very clear abt your greviances and complaints-- and be sure they r valid and supported by testimony), A proof of the replacement of your phone, then another proof of your second complaint..the proof can be a phone call (ur record of phone calls are available with airtel or whichever network ur using- and can be easily procured) or just a bill or a letter or something else---however if in 15 days they provide you with an all right working phone - then there is no reason why you should sue them and seek compensation  except for a bit unintended harassment

    if possible try to have an evidence against Subhiksha people that they have sold you a damaged product and that they have harassed you, made you do rounds of thier store and asked you to buy a more expensive phone... Since its responsibility of the store to replace a phone thats not working properly and not of the customer to directly approach the company you can say that they did not help you and didnt provide the rightful service

    to build your case first find out about your basic rights with store keepers and companies- only then u will be able to do the needful. Search the site of consumer rights or consumer forum for initial and basic info abt your rights etc..then visit and find out the most you can- only after tht u can and have to built your case on your own- and thts not a problem because its quiet easy

    Consumer courts dont take much time and resolve the cases on early dates too. They get you fair compensation and retreival too-- so dont be dissuaded by people who tell you not to be involved in all this, or 'avoid this and this and that'- lot of people are going to discourage you-- but go ahead if it makes sense -- its d**n easy and people just dont know how to excercise thier rights-- this country is still in oblivion about how to go about things
