Question:

I cannot work 10 hours a day. I have to pickup my 2 kids from daycare by 6pm?

what are my rights i work in california. I have no one that can pickup my children, i work from 8:30 to 5:15pm. i drop off my children at 7:45pm at school, and pickup at 6pm.

  1. If you put the hours you could work on your employment application and it does not include the hours they are wanting you to work but they hired you anyway "without stipulating that you may have to work other hours besides what you put down"  then they have to honor that! So if you put that you could only work until 5:15 then they have to let you go then!  Just like if you put down that you could not work on Sundays and they scheduled you for a Sunday, you could go to them and say," If you look at my application, I specifically told you I couldn't work on this day and you hired me anyway!"  Good luck!  Go to momsrising.org to see if there is anything else you can do!


  2. check your phone book. It should be under government listings. I would think if you don't like it, you might just have to find another job or hire a sitter/nanny. Do you have a neighbour who would be willing to helps out? Family? What about your childrens father, could he look after them?

  3. You don't have any specific rights to get off work before I do, just because you have children.  What you should do is make sure other people who may have children in their future know what you are going though, so they will think twice.  You owe that to your friends.

  5. I don't think you have any rights. It probably depends on your job, if you are in a union, if you have an employment contract, if you have been singled out or if everyone is expected to work 10 hr days.

    I don't think that having children is a protected status meaning something for which an employer can be penalized for discriminating.

    You should probably contact a lawyer or state employment office. There might be some free advocates.

    If you don't have a contract, I think in California you can be fired at any time for any reason barring discrimination.

    I know how you feel i use to drop my daughter off at 7am as i had to be at work for 7.30 which i use to get there for 7.25am. I then finished at 5pm and had to pick her up before 6pm. I was abosulty exausted and so was she falling asleep on the way home and in bed for 6.15pm i hardly ever saw her but i had to work full time.

    i then changed my job within the company for better working hours and also changed my daughter's nursery (not easy as she had been there for nearly 3 years and had made alot of friends)

    I now drop her off at 8.45am and i don't start work till 9.15 (working arrangement as my child is under 6 years old) and then i finish at 5.30pm and manage to pick her up at 5.45pm.

    She is alot less tired as i use to have to get her up at 6am and now she can stay in bed till 7.30am. she now stays up till at least 8pm and we get to spend loads of time together and she is alot happier for this...

    We have different agreements in the uk to you guys in California but i would speek to citizens advice to see where you stand and see if you can sort out a working agreement with your boss which would entitle you to lower your hours and be able to pick the kids up earlier.
