Question:

I decided against a certain mobile contract, am I liable for the £411 cost of phone due to a small scratch?

A third party mobile contract seling company sold me a phone, and misled me about the international rates. I returned with 3 days, as they had a 14 return policy. They threatned that I couldn't send back, and my 2 year contract with orange must be honoured. Orange terminated the contract, so all was fine there.

The phone was perfect, except it had a slight scractch on the screen. I offered to pay for damage, but they have sent me the phone back, and a bill for £411.

they told me the phone was insured when i purchased, but now they say it wasn't.

I know i should pay something for the damage, but this company threatened that I may lose my business mobile number.They were very pushy and unprofessional.

So the question is, do I legally have to buy the phone from them?

  1. You will have to read the contract or agreement you signed.

    To return an item it is generally assumed that you must return it in the same condition as when you bought it.  The 3rd party phone companies are very pushy and shady, I would say your best bet is it just pay for the phone then resell it on ebay or something to recoup most of your cost.  A small scratch won't hurt you when trying to resell the phone very much.
