I feel so frustrated about my K-3 visa application now, can anyone help?

I'm a chinese student studying in Canada with student visa. I got married with a US citizen last July, we've known for more than 6 years. He filed i130 last september and 129f last november. Now, these two cases are still pending, i have no idea how long i should wait for it. I need to attend his brother-in-law's wedding in May, can i first apply a visitor visa to go there? cuz it is very unlikely that my K-3 can be done before May. Does anyone has any related experience? Thanks.

  1. you can apply for the visitor's visa and that is unaffected by the other application.   Since you are already married I am not sure why you filed a finance visa?


  2. for canada, it takes about a year or so from start to finish. my husband and i went through the i-130 and k3 in canada as well.

    no, your application for a tourist visa will be denied. they will never allow you to enter the US when you have an immigrant visa pending. i applied for one myself so i can visit my husband but nope, was denied.

    a wedding is not that important. you could miss it and the wedding will still go on as planned. as far as they're concerned... you have no immediate concerns to enter the US... and no reason for you not to wait in canada while the applications are in process.

  3. You are a documented, intending immigrant.  Technically, non-immigrant and immigrant visas are not necessarily mutually exclusive.  Unfortunately, too many people have used non-immigrant visas to go to the US in order to wait out their immigrant visa processing time, thereby effectively by-passing the requisite wait period.  Consequently, as Helo Pilot above experienced, the reality is that it is very unlikely that you would be approved.

  4. No chance on the visitor visa.

    Don't sweat the wedding. You probably won't make it.

    Live your lives as fully as possible while in limbo, until you get your papers.

  5. they will deny your visa to enter the USA  you are in course of immigration    you need to cancel the I129   its confusing the issues  at USCIS nd DHS   regardless of you 130 filing  until its approve  very doubtfully they will consider a visitor entry  i130  can atke up to one yrs to finalize it
