Question:

I filed for bankruptcy and on the very last day of signing the attorney changed the figures.?

On the very last day I could possibly sign and save my home the attorney's office had changed the monthly payment and upped it by $350.00. It was going to be hard enough but now nearly impossible! I went home and did some calculating and with what I am paying to the trustee I could have paid the bills!! I saved no money at all. I had already settled with one credit card company and feel assured I could have settled with another but my mortgage company wasn't as reasonable. With what I paid to the attorney already I could have caught up. Boy did I mess up! Do I have any recourse? I just feel stuck.

  1. Did you sign? Then you are stuck. Changing should have been reason to stop and think.

    Credit counselling services exist, that put all your bills together and freeze the interest till you are paid off. Ask around.

  3. You can contact another attorney and see them on a free consultation. Bring your case# and paperwork with you and they have access to the bankruptcy trustee website and your information, so they will be able to tell you if all was calculated correctly. FYI, the information that was provided to the attorney and their calculation is not set in stone, the trustee has the final say in how much is paid into the plan, so, it's not the attorney changing the amount, it's the trustees changing it and upping your amount. You may feel stuck and you may feel that you could have paid this on your own, but...you are protected under the bankruptcy laws. Now....you may be able to modify the plan payments if you let something go, to get rid of some debts. Go see a second attorney and see what they say, you have every right to fire an existing attorney, all it takes is a letter firing them, but, you'd have to retain the new one. Good Luck!
