I found out i had a child and she was already 6yrs old now they want me to pay backpay child support?

I live in N.M. the mother thought another guy was the dad she went to get him for child support he took DNA it was negative I was next it turned out it was mine now I got stuck with 25,000 dollars of child support back pay I pay some to the state and her this cannot be right help

  1. Now, first of all did you wear protection?  Was this the love of your life?

    or was she just available?  I am sorry this happened to you.  But now you are a Dad and you have to step up to the plate.   I want you to examine how you go about dating or selecting who you are going to date. Don't jump into bed because she's there.  Life has more meaning than that.  You want to find the one for you.  Not the ones for you.

    Find that one special person to love and build a life with.  Unfortunately nobody teaches you this in school.  But they do teach you how to wear a condom.  You have your whole life ahead of you.  Don't mess up any further.  You do have to take responsibility here. Remember my words.  Look for that special lady.


  2. Get a good lawyer. Since she herself didn't know the father at first. meaning she has lots of men in her life. anyway. since it is yours support the child. But get a lawyer.  

  3. Get with an attorney.

    Are you certain its yours? I mean you did take a DNA test didnt you? A reliable test by a independent 3rd party company that had nothing to gain from it right? Get with your own attorney, get him/her to set up another DNA test so you can be certain of the results.

    I always am suspicious when its a woman who has to go through several men getting checked....it could be anyones.

    Also as others have said, some states do not require back-pay so you might not be required to pay that. But if the kid is yours you will and should have to pay for it from this day forward. If its yours bite the bullet and do the right thing-pay for it from now on but try to work out a deal  where you dont have to pay for the past - the 25 grand.

Not sure about N.M but I know here in Ohio legally you can't be held liable for backsupport that goes beyond the original filing.  Like for example if she just filed the support 2 months ago then from that point you would be responsible but like I said I don't know about N.M.  I know if she has been on government assistance (getting cash assistance) then you would be paying some back on that.  

  5. by law in most states the man that is 'acting' as the father to the child is by law the father,.. DNA or no DNA..  

    So if this man was around the child and helped raise it then he is responsible for the back child support,,

  6. Check your local laws, Usually one begins to owe child support from the time paternity is established. This means that back pay is not possible.

    The courts will be the ones to decide if back pay is to be payed.

    Go to legal aid....they have pro-bono legal counsel.

  7. Bad news bubba...every state does it.  All I can say is make sure you don't miss a payment.
