Now i want to show the house to future tenants.. how do i go by getting that done in tennessee

  1. Check. Most states you can enter a rental by giving the renter 7 days notice.


  2. Since your state has no requirement for notice to enter, you are going to have to work with the current tenant in finding a reasonable solution.

    Communicate with the tenant. Offer to give 24-48 hours notice and see what comes of it. If the tenant is hesitant, perhaps you can offer a cash incentive but only pay out AFTER you have been able to show the place.

    The fact is if the tenant refuses to allow you entry, you are going to have to get an injunction through the courts or terminate the agreement. How long would the court process take? Who knows. Since the tenant is moving anyways, termination is a hollow threat.

    You do have the right to enter, but it is not defined in what specific situations. The tenant cannot refuse to allow you lawful access, but there is no definition of lawful access.

    *In the future add a clause to your lease regarding landlord entry. If an issue is not defined in your state's landlord/tenant laws, you can do so in your lease.

    The tenant shall not unreasonably withhold consent to the landlord to enter into the dwelling unit in order to inspect the premises, make necessary or agreed to repairs, alterations or improvements, supply necessary or agreed to services or exhibit the dwelling unit to prospective or actual purchasers, mortgagees, tenants, workmen or contractors.

    The landlord shall give the tenant 24 hours written notice of his intent to enter and may enter only at reasonable times, except in case of emergency.

    The landlord may enter the dwelling unit without consent of the tenant in case of emergency.

    66-28-513. Remedies for abuse of access.

    (a) If the tenant refuses to allow lawful access, the landlord may obtain injunctive relief to compel access, or terminate the rental agreement. In either case, the landlord may recover actual damages and reasonable attorney's fees.

    (b) If the landlord makes an unlawful entry or a lawful entry in an unreasonable manner or makes repeated demands for entry otherwise lawful but which have the effect of unreasonably harassing the tenant, the tenant may obtain injunctive relief to prevent the recurrence of the conduct, or terminate the rental agreement. In either case, the tenant may recover actual damages and reasonable attorney's fees.

  3. That depends on state law and the lease that you have with your tenant.  Many leases stipulate that, upon receiving notice from the tenant, that the apartment may be shown - provided 24 hour notice is given to the tenant.

    Tenants always get bent out of shape over this, and here is the deal that I cut them:

    I tell them I'll give them a small discount on that last month, or if they leave the place broom clean (all debris removed)..that I'll thoroughly clean for free...get creative..in exchange for them keeping the place reasonably tidy...and ASSURE them that you will be with them during showings, offer to do it during the day while they are at work.

    Tenants are most concerned about pets being "let out" and belongings being stolen...if you assure them that you will secure these, they will be more likely to allow it.

    I rarely, rarely have an issue, but legally, they cannot stop you.

  7. Ask the tenant if you can take some time to show the house to others.  Set up a time to do this.
