I got a ticket but no cops were there only witnesses. Is it fightable?

I got a reckless driving ticket cause i was speeding down a 40mph road and i did a lane change when i car suddenly lost control. Perhaps a tire popped or something i dont remember much but i totaled the car. But after i got out cops came and there were witnesses saying that i was speeding like 90mph and i lost control and that i was racing some other car. Ok so theres the thing. The cops wrote me down for a reckless driving ticket going 90mph on a 35mph when the road was really a 40mph and the cops were never there to see anything. How could they write me a ticket for something this lady and her daughter saw. They arent cops to determine the speed i was going. And on top of that, they spread rumors that i was racing some other car.

  1. Witnesses who have nothing to gain by acting as witnesses will be highly regarded in the court.  Obviously you were doing something wrong and they saw what it was that caused the accident.  I would just get a lawyer and figure out a way to avoid maximum points on your license or suspension.

  3. take it to court and make the witnesses go on the stand. the police would have gotten a detailed witness account. They would have to testify under oath. If they lie they can go to jail so they have good reason to tell he truth. You have a lapse in memory which isn't in your favor. Also Police are trained to estimate a cars speed and direction based on the impact. You can argue the 40mph ruling by proviong its a 40mph zone but forensics could play against you in court, sorry

  4. You have the right to contest any citation. However, before you do... you may want to look at what the court will consider.

    Losing control of a car, without reason, will be used as evidence you were driving too fast. That, along with the witnesses and officer's professional opinion, will probably be enough for a conviction.

    The officer's testimony is almost always given more credibility in court. The witnesses, unless they were directly involved, will be considered "disinterested parties". Because they have no interest in the outcome, they too will be given more credibility.

  6. Based on witness accounts and physical evidence at the scene an officer can and will cite you.

    So by your logic, if a police officer didn't SEE a murder.........No one can be charged...........

  8. I gotta say this:  You did state here that you were speeding, or at least that is what it looks like.

    However, on the assumption that you are telling the truth, here is how it is going to play out.

    The police, if they are really sharp, can determine vehicle speed by measuring skid marks, distance of roll, and/or how far your vehicle slid after you lost control.

    If those calculations are not on the police report, it may be a good idea to challenge the civilian bystanders statement.  You should go door to door in the immediate area as soon as possible to find out if there were any other witnesses that can back up your story.

    Also get statements from neighbors as to the witnesses bias and past history of complaints.

    A good attorney can tear their statements apart in court if they are lying and you have witnesses in your favor.

    You may have to provide a reasonable excuse for making the lane change that caused the loss of control.

    But honestly, if you have no witnesses, it will be a very hard case to prove if the cops did their homework.

  9. I hope whether you fight it or not that you learned something from this. You should count your blessings that the only charges are reckless driving and speeding. If you would have killed that lady and/or her daughter or anyone else you could be facing murder charges. The next time your family could be grieving you or someone else's family may be grieving because you. Please be more careful when you are on the roads that we share.
