I got a ticket for entering a freeway from carpool lane & threatened with a 148(p.c.) violation, Help me!

Question

Everything was cool I was getting the ticket the cop said his partner seen me enter everything was real calm so when he brought me the ticket I started to write a note about the officer's partner seeing me do this, he got upset that I was making a note on the ticket and snatched the clipboard scratching my arm then when I requested a supervisor, they threatened me with a 148p.c. violation, and said the D.A. would be contacting me but didn't put it in the citation, also the sargeant didn't take pictures of my injury. so a couple of things 1) can i be cited with 148p.c., 2) didn't they have to put it on the ticket 3) I didn't refuse to sign ticket i just made a simple note 4) should i make a formal complaint or civil complaint regarding my injury from his aggressive behavior.

Your question isn't as clear as it could be and I'm certain there's more to this than you've posted, but here we go anyway:

1) No way to tell.  There's more to this.

2) Nope.

3) Okay.

4) Tell me what the difference is between a formal and a civil complaint and I can probably give you an answer.  If you're talking about filing a lawsuit (also known as a civil complaint), there's no way in the world anyone here can give you competent advice on that issue without knowing a lot more about what took place.

And no, despite what you've read here, you do not have the right to make notes on a citation.  You have the right to sign it or go to jail, period.

I don't understand fully what happened. But there's nothing wrong with you writing a note on the ticket. The way the officers acted was not necessary. Police officers usually get a little bit of a 'god' complex and think that they have the right to scare the c**p out of you. You should definitely complain, I would write a formal letter to the polica station to the person in charge.
