I got a ticket in florida and the officer checked the wrong box?

I recently got a speeding ticket for going 30 over. I know it is dangerous but i was getting ready to slow down and i crossed the 55 mark and thats when the cop got me right when i crossed it. He said in Florida if you are going 30 over it requires a mandatory court date and wrote one at the bottom of the ticket. But he checked the box that says infraction which does not require apperance in court. Does this mean i can get the charges dropped since technically according to the ticket i dont need to go to court?

  1. I do not know about FL law, but in my state, nearly every moving violation is an infraction, and many infractions require  a court appearance, so my suggestion is go to court. Many jurisdictions allow time before court opens to speak to the prosecuting attorney to work out a plea deal, go in early and speak to the prosecutor, they may drop the charge if indeed it was incorrectly marked, or they may lower the fine, or nothing may happen and you will be stuck with the fine and the points. However, failure to appear may result in immediate suspension of you license.

  3. I went to court before over a ticket that the cop forgot to check whether it was radar or pace. The judge looked at his copy and said "it's checked radar here" but I told him to look at my copy and sure enuff nothing was checked, so he tossed it out! :-)

  4. The ticket will say one and someone will pickup on this, so it would be better if you just went to court instead of receiving a warranty for your arrest.
