Question:

I got fired... did they have the right to do this?

i have been working at my job for 2 years, everything was fine untill about 2 months ago we got a new manager (the old ones stayed we just got another one) everything i do he picks on, writes me up, screams at me untill i cry, and calls me out in front of everyone including customers!

today they finally fired me. but their reason was.... "my personality flaws" and that i am "a huge b*tch to the managers but kind to customers".

they even told me i was one of their best employees as far as my skills, sales, and dealing with annoying customers but that my personality out weighted my good skills.

ps. i am seriously the kindest person ever who is just here to have a good time, and make others happy, i am not a grumpy bump on a log like all the other people i work with!

can you seriously get fired for having personality flaws in such a huge corporation? (pepper dining/brinker)

pps. i worked at chili's!

  1. They have as much right to fire you as you have to quit.

    You should get unemployment. It doesn't matter that you're 19 and work 20-30 hours. Go immediately to the unemployment office!


  2. Sadly, it is your employers choice whether to keep you around or fire you. Sometimes you get into it with a rough manager. Things happen, and I suggest looking for another job. Try McDonalds. I'm a manager at a small McDonalds, and employee relations are always great.

    Ever hear the saying  " a new brook sweeps clean?  "" Well, that is what happened to you.,

      You got a new manager, and he "inherited " people hired by the old manager. Now,. he wats to get "His" people there.

    You may have been the greatest employee there ever  was, but you weren't hired by him.

    You'll find a better job, Trust me. Trust yourself. Good luck/

    Why not apply for unemployment. The worst thing they can do is deny your claim., You can file on line. Google your state, and"unemployment."

         I think they did you a favor ... find yourself a better job ...

  6. As a former mediator, yours is an interesting, but very one-sided story.  One thing we learned in court was the existence of two sides to every conflict.

    Without hearing the other side's comments, it's easy to take your position in this matter.  However, more than one outrageous story has been completely blown out of the water with a rebuttal by the other side.

    You sound too good to be true!  Your story sounds way too one sided.  I have to believe there is more to this than is being said.

    Corporations are not run by idiots who are ignorant of the law.  There are always very carefully documented reasons for dismissal and appropriate warnings beforehand.  

    Are you saying this caught you by surprise?  There were no warnings, or documented problems with your performance?  If so, you may have a case and should consult an attorney.  Otherwise, start looking for another job, and be careful what you say about your employers on a public forum when you use their name.  I'd delete that if I were you.


  7. IMO, no, he was wrong to fire you on those grounds. But, rules are rules, and in some states, managers can fire you legally without a reason. I think that applies to Florida, but then again, everything is messed up in Florida.

    But, hey, if the guy was a jerk, why would you want to work for him anyways? If my manager was a jerk and did the things that you said he did, I would quit before he had the chance to fire me.

    My mom got a job at a restaurant, and the manager was horrible to everyone. He would yell and call them names until they cried, and had the most awful/ridiculous rules. The working conditions were disgusting, and all the coworkers were overworked and underpaid. My mom quit after the very first day.

  8. You don't fit on their team and they can terminate your employment for that reason.  File for unemployment.  You will likely collect if that is the only reason that you were fired.

  9. Yes they can fire you.  Apply for unemployment anyway - you are very possibly eligible, and the worst they can say is no.
