I got in a car accident

I pay for full coverage insurance on my car. The other day my dad loaned me his car and i got into an accident. The problem comes were my mom sent the payment for my dads insurance late, and it was my fault. We both have State Farm and they tell me that my dads insurance is the one that is supposed to cover it but being that they never received the payment they are not going to cover it. Is that correct. I always thought my insurance would cover the damage. now I'm worried that now i can get sued or what can happened. I live in Florida and its a no fault state.

  2. Insurance coverage does NOT cover a person driving another person's vehicle. Insurance only stays with the vehicle. If you were in an accident in your fathers vehicle then only his insurance would cover the accident. If his coverage lapsed for non-payment then you are probably out of luck. Your insurance coverage from your vehicle will not extend to your fathers vehicle.  

  3. sounds like you have talked to the insurance company.  the other party's insurance company will sue you as the driver, and your father as the owner.

    your insurance may cover you if you rent a car or if you allow certain persons to use YOUR car. read your policy.

  4. Do some checking into the grace period wich is usealy 30 days befor your Dads insurance would lapse.

  5. take a closer look at your policy ... you're policy ought to cover you driving another car.

  6. They are correct. State farm has the OPTION of extending coverage if they receive a payment late, but it is completely up to them. By the way, Florida is NOT a no-fault state. It's tough but you will have to pay for the damages. The insurance company will let you make payments to them but for God's sake, don't be late with THEM! They'll slap a lawsuit on you so fast you won't know what happened -- then you'll have to explain it to a judge.
