I got into a car accident without insurance?

on the freeway I looked over my shoulder and there was another car miles away so I thought I had time to merge onto the right lane going north bound. Suddenly, the other car hit me on the rear end of my car. It seems to me that he wanted to scare me by accelerating and stopping right before he would get close but he lost control. Now the police was in favored of the guy that hit me because I supposedly cut him off. My insurance had canceled two weeks before the accident. The other party's insurance is trying to sue me for his damages. And I'm worried. What should I do??

  1. Dont drive wiout insurance. Simple. They'l get as much as they possibly can out of u.


  2. There is nothing you can do except hire a lawyer to defend yourself.  Be prepared, however to lose the suit and be required to pay.  In fact You may end up paying for the rest of your life.

  4. yep you are going to pay for the car and most likey lose your license for driving without insurance.... here the fine is 1000 buck for no insurance.. what you should do is start trying to take out a loan for the damage

  5. You have good reason to be worried.

    I own a company that handles claims against uninsured motorists for insurance companies. You don't say what state you are in so the info below should be considered just as general info to help you see what you are faced with.

    Depending on what state you are in your drivers license is at risk and you also face fines for driving without insurance. Believe it or not those are the easy things.

    You will have to re-pay the insurance company for the other driver. I strongly suggest that you don't ignore them when they ask for reimbursement. That will only make them sue which will add lawyer fees, court costs and interest to the original debt. That can sometimes add 30% to 70% to the amount you owe.

    If in fact the insurance company has filed a lawsuit against you, then you are real trouble as that would indicate that they gave you a chance to enter into a voluntary settlement but you didn't do that.

    If they have not sued you yet but are just asking for reimbursement then you need to ask them for the following information.

    -Copies of the damage estimate

    -Photos of the damaged car.

    -Copy of any checks used to pay the claim

    -Copies of any releases signed by the other driver or injured passengers.

    -Whether or not what you owe is reduced for the  "comparative negligence" of their driver.

    If a lawsuit has not been filed yet, you can try to set up a monthly payment plan. Make sure you can make the payments because if you default, you will lose your license until you repair the agreed amount.  

        

    And please go buy some liability insurance.

    You are in BIG trouble..you should be VERY worried.

    wait till you see what your insurance rates will be, but don't worry, you wont be driving for at least 6 months.

  8. You should prepared to be sued & taken to court. What do you mean "what should I do?" You weren't worried about "what to do" when you were driving with no insurance. I'm sure you don't want to hear all the sh*t talking, but its the truth. Your insurance company mails you a letter stating the date your insurance will be cancelled (well at least state farm does) so you won't be without insurance. You knew the date you were getting cancelled, so the date you received the notification, you should of been on your search for new insurance. Now you are going to have to come out of pocket. The court may put you on a payment plan where for ex: you pay $200 a month until you have reached the ordered amount. I don't know for sure, thats just what I heard is a possibility. The court is going to charge you with driving with no insurance, so that will be a point on your driving record. You will have to pay a fine for that and you will be required to have a SR-22 as well.
