I got into an accident with a moped, HELP!?

Ok, earlier today i got into an accident when i was pulling into a drive way with the sun glaring i hit a guy on a moped, i got fault, but im conserned that im not to blame, i just figured out that the guy driving the moped wasnt the owner of it, it was his friends, just baught it that day, saying they just got done putting it together... dont know why you'd buy a moped just to build it?? and it had no insurance, nor plate yet, he didnt even have any protective gear on eather, it was a black Moped Touring 150cc? what ever that is. and i think you need a special license to drive a moped above 50cc in Florida? and when i hit him he went flying pretty far, about a car length, i dont know if that helps me back up that he probably was speeding? but yeah. i have a court date soon, is there a chance id lose or win?

In this case it has nothing to do with whether or not the moped driver should have a license.  It has everything to do with whether you hit him or he hit you.  Plain and simple.  People like you should be ashamed of yourself.  I know your type.  I&#039;ve seen your type on the road everyday.  You are reckless and inconsiderate.  You are not even concerned whether or not he is ok.  You said that he went flying pretty far and now your only concerned is who is at fault???  If I were the judge I will make sure that you lose.  One more thing, it has nothing to do with &quot;the sun glaring&quot;.  The sun rises and sets everyday.  Now you are blaming the sun too???  Grow up!  People like you should NOT be allowed to drive.

    BUT you are not automatically at fault when you hit a pedestrian. On top of which, he was NOT a pedestrian.

    Accidents are usually &#039;rated&#039; by percentage of fault. At what point is it considered that he hit you? If someone hits you in cross traffic at an intersection, and hits the side of your car you&#039;d be less at fault than if he hit the front of your car -- in which case it&#039;d be that you hit him. There are a lot of variables - do not ever admit fault.

    He was an inexperienced driver - and possible riding a vehicle that had not been assembled properly!

    Did he drive in front of your car? How did it happen? Did you hit him with the front of your car, or maybe a glancing hit to the side? If you hit him smack with the front of your car, you&#039;ll be more at fault.

    Also, a moped, by definition, is 50cc or less, is incapable of going over 35MPH, and has pedals. If what hit you has a 150cc engine it was a scooter or a motorcycle. This is an important distinction as mopeds in some states do jnot require the driver to be licensed.

    The word moped is a portmanteau of motor and pedal.
