Ok so here's what happened, somebody turned left in front of me and I hit them. We both had a green light so it was her fault BUT, the police report reads that she said she had a green arrow, so because of conflicting stories, no ticket was issued. That's all fine and good except that the car I was driving was my girlfriends and she didn't have insurance. Now the lady I hit's insurance company is saying I'm responsible for the damages because she told them that she had a green arrow. Do I need to pay up because I was driving an uninsured car EVEN THOUGH the accident wasn't my fault?

  1. If its your word against hers you should take it to court.

They can't just say they aren't paying bc their client said so and so.

What does the police report say regarding the arrow? Thats what they should decide based on.

  2. Happened in TN, where the law is to drive a car that YOU the person have to have liability insurance, which I had for MY car, not hers though.

  3. depends on the state

  4. The ladys insurance company is coming after you because she used them to repair her car since you didn't have insurance.  She (they) would have to take you to court to collect.   If she did, it would be likely that you are each found 50% at fault which means you would split the total repair costs for both vehicles.   Her insurance company is smart enough to determine this on their own.  If you tell them you are not going to pay, I doubt they will pursue it.
