I have 5 acres, how can I refer to the survey and deed and write up 5 deeds into equal shares for my children.

I do not think there is a need to pay a surveyer to come out and do another survey since I have a good suvey with the present corners well marked.

Hi, Make an appointment with your local official in building and zoning first.  The original land survey is just a building block to start with in this case.There are usually alot of rules to follow doing a subdivision of land like this.  Make a copy of your survey for him that he can markup and make notes on. This costs nothing usually. Fulfill all the requirements and then take the rough draft to a surveyor to plot out as well as putting pins in the ground. Most local governments will not recognize a land subdivision without having the actual pins in the ground installed by a licensed surveyor. Too many problems in the past. Then the local government may require an official to sign the subdivision plat and then you get to record the document in the clerk and recorders office. Lots of potential steps. Really this will all begin with the meeting with the local official land planner. Hope this helps.


  2. you did not state what State your in, in TN all we have to do is transfer it, no $ involved, a acre i think is around 60 ft by 120 ft, or 160rods, look up acreage, stake it off, and let it go as that.

    every one will have access to there land even if it means crossing the other section,s

    You'll need the land subdivided into 5 separate lots to deed it out that way, something you'll need the surveyor to do.  You also might want to check to make sure once divided, you are zoned to build on that size lot.  Take into consideration that once subdivided, each lot will have its on tax payment, and that it will take a good deal of paper work and time to get this done.

  4. Nice thought but, have you considered the fact that each will need access to their acre without infringing on at least part of anothers property?

You have to take that matter to your county clerks office and then the tax appraisal office in order to fill out al the necessary paper work and have the new lines drawn so each can begin paying taxes on their plot. If this is for a WILL then you need only take it to the lawyers office and have them divide it into equal shares on paper including the current survey you have. That way, when you pass, it will already be drawn out for each person and no one can dispute your wishes as they will be clearly and legally marked.
