  1. Sure, you can apply, but you more than likely will not get it. Having the I-130 filed shows that you are intending to immigrate to the States. Knowing this, the Consulate will consider you to be a bad risk for a non-immigrant visa. So, you can apply, but why not buy yourself a gift with the $131 that you will be throwing away in the attempt?


  2. I don't think so but you should contact a lawyer to know definitely...
