Question:

I have a Clean Record but made a stupid mistake, am I going to jail?

To make a long story short I have NEVER been in trouble before but got myself in a bad situation I was working as a store manager and became good friends w/ the DM ( my boss) during the time I worked there we started getting our check Direct Deposited and I wasn't keeping up w/ my spending very well my account became overdrawn so when my check went into my account my NSF fees ate my check and I couldn't pay my bills so my DM said that I could borrow the money from our petty cash fund ( money we use for supplies and change) and then pay it back, well that happened twice in a row so I borrowed to checks worth $800 and I was supposed to pay that back she didn't want anyone else to know bc she was doing me a favor and wasn't really supposed to let me borrow it, then there was an incident with a employee we had were $200 went missing but we couldn't prove he took it so my DM said that everyone who worked that day had to help pay it back to avoided having to file an incident report and have an investagation well we were being audited and I didn't want to get anyone in trouble so I took money from our deposits to put into the petty cash box basically moved money around to buy more time to pay it back but got caught before I had the chance, I am not a bad person, I do not steal but did some VERY stupid things Most of this is my own fault but I also feel like I was being poorly managed and this was my first management position.... AM I GOING TO JAIL for this??????? and what should I do??

  1.   Explain that to your lawyer and he will get you off. You will probably get probabtion and a tarnished record.  


  2. I'm sure you won't go to jail, but I'm also sure you won't manage again, at least for a very long time........

  3. your lucky an incident report was not filed or you would be out of a job and in jail, you took money from your employer to pay your debts and your DM gave you the ok, wow that's a new one, how much is she taking for herself? you better make sure you pay back what you borrowed to clear your name and hope your DM admits she said it was ok for you to do it.

  4. Breath easy. You are not going to jail for this. You don't mention the actual amount you were actually caught with, but the level is either going to be a petty offense or misdemeanor depending upon where you live. Make sure you go to court when you are supposed to and you will not see the inside of a cell.

    You will (or have already?) likely lose your job.

    However, the DM has much of the responsibility here, including the dubious practice of coercing their employees to pay off shortages, to circumvent internal audit procedures...very dodgy.

    Treat this as a learning experience; Learn some budgeting skills so you are better able to handle your money in the future; differentiate between bosses, co-workers, employees and friends; decide upon what type of employee and manager you want to be...someone who can be trusted to do the right thing, or someone who gets caught digging themselves into a hole.

    Don't let this one experience define who you are.

  6. it's going to depend highly on what your mgr says. is she going to back you up on lending the money or leave you hanging. if she doesn't admit to giving the ok on the petty cash they are going to think you're trying to lie your way out of the situation and you might get some jail time. try getting the money back before court. beg, borrow or sell something.

  7. you didn't steal ? just took money that wasn't yours. It is called fraud and theft. If the DM tells the police then the district atty will file charges. They will probably offer you probation for a misdemeanor. Maybe a fine. No jail.  

    You will not be able to get another job where you are responsible for money.
